There is currently no legislation permitting online poker in the state.

Like North Dakota, South Dakota allows pari-mutuel wagering at licensed horse racing and dog racing tracks, and they also allow simulcast betting. South Dakota has had a lottery since 1987.

The state also allows casinos on Native American-owned land, with nine presently operating in various locations throughout the state. Bars and taverns can have a limited number of "video lottery terminals" that allow patrons to play keno, blackjack, bingo, and video poker.

The city of Deadwood, South Dakota is of course historically important when it comes to poker as the site where James Butler "Wild Bill" Hickok famously played his last "dead man's hand" of poker before being killed in 1876. As a nod to that past, casinos are allowed in Deadwood with the first opening in 1989. The sites are often historical in nature, and indeed one can even play poker at the famous No. 10 Saloon where Hickok met his end.

South Dakota voters approved sports betting in 2020, with legal sportsbooks reaching the state in 2021. Meanwhile, there is no impetus at present to consider legislation that would permit online gambling or online poker.
